S.F. Chronicle: Prop. 8 Judge Is Gay

San Francisco Chronicle columnists Phillip Matier and Andrew Ross write in their Sunday column an aspect of the Prop. 8 trial the media didn’t touch on while it was under way — that Judge Vaughn Walker is gay.

Reads the column: “Many gay politicians in San Francisco and lawyers who have had dealings with Walker say the 65-year-old jurist, appointed to the bench by President George H.W. Bush in 1989, has never taken pains to disguise — or advertise — his orientation. They also don't believe it will influence how he rules on the case he's now hearing — whether Proposition 8, the 2008 ballot measure approved by state voters to ban same-sex marriage, unconstitutionally discriminates against gays and lesbians.

“‘There is nothing about Walker as a judge to indicate that his sexual orientation, other than being an interesting factor, will in any way bias his view,’ said Kate Kendell, head of the National Center for Lesbian Rights, which is supporting the lawsuit to overturn Prop. 8.”

The article touches on the fact that when Walker first set out to become a judge, “a major obstacle he had to overcome was the perception that he was anti-gay." As a lawyer, Walker was criticized when “he represented the U.S. Olympic Committee in a successful bid to keep San Francisco's Gay Olympics from infringing on its name.”

Walker didn’t seek out the federal Prop. 8 case — it was assigned to him at random.

    To make these proceedings unbiased, 50% of the judges on the panel should be gay, not just one.

We do not care here in San Francisco, mostly because we accept that being gay in high office is normal, being gay and abiding one’s oath is normal, being gay and applying law correctly and fairly is normal. As long as his religious views do not influence judgment, we do not care that Alito is a man, that Bader Ginsburg is a woman and nor do we care that Clarence Thomas is African America. We understand that their judgments are unlikely to be impacted by these facts. We also do not “out” Ruth Bader Ginsberg as a “straight women.”

    This is completely irrelevant, interesting absolutely, but irrelevant nonetheless. If Prop 8 is defeated is found unconstitutional, it will likely go to the Supreme Court. If Prop 8 is upheld, it will likely go to the Supreme Court.

    I don't necessarily believe this is any advantage. If anything, many gays in politics or in society take the non-gay view to "prove" that they are unbiased, joke on us. I just hope this isn't the case here.

    I agree with Brandi - the CONServatives will scream bloody murder IF Judge Walker rules in our favor. BUT, like Cleo, I'm afraid that he might pull a gay CONServative & overcompensate by ruling against us. @ Joe from Detroit - 6 U.S. Supreme Court justices are Catholic (Sotomayor, Kennedy, Roberts, Alito, Thomas, & Scalia). Of those 6, all except for Sotomayor ruled for taking away restrictions on corporate spending in political campaigns in a recent case.

    Hi bob. All three are catholic like you stated. Also alito, sotomeyer (or at least use to be) and I believe Stevens is. I do know that six out of the nine are.

    Roberts, Scalia and I believe Thomas are all Roman Catholic and should never be asked to sit on a case deciding Abortion, Immigration (because the Latinos are very Roman Catholic) Gay Rights or DADT because it conflicts wit their Catholicism. What an absurd notion! We have judges in this country who are supposed to be non-partisan in politics and religious ideology and I believe Prop 8 will be decided fairly based on the Judicial Facts, not on personal prejudice.
