The Great Undoing?

Could a seemingly obscure Supreme Court ruling from 37 years ago prove the undoing of the effort to overturn California's Prop. 8 and establish a federal right to same-sex marriage?

As all sides gear up to do battle over the Prop. 8 suit filed in the San Francisco district court last month by superstar lawyers Ted Olson and David Boies, constitutional experts sympathetic to the marriage equality cause are expressing deep concern over the 1972 case known as Baker v. Nelson and its potential to scupper every last argument about equal protection and due process under the U.S. Constitution.

Here's why.

Baker v. Nelson was a very early same-sex marriage case pitting two gay student activists from the University of Minnesota against the clerk of the county court in Minneapolis. The activists wanted to get married and applied for a license. The clerk said no, on the grounds that they were two men, not a man and a woman. The case went to court, and the activists lost at every stage, all the way up to the Minnesota supreme court and beyond. The U.S. Supreme Court, for its part, refused to hear the case, citing a lack of a "substantial federal question."

So far, unsurprising, given the times.

The problem stems from the fact that, at the time, the Supreme Court enjoyed something known as "mandatory appellate jurisdiction." In plain English, this meant that once the Supreme Court ruled on a legal matter, only the Supreme Court had the power to reverse the decision. The lower courts' hands were tied, and if any subsequent case came their way they had no choice but to say they had no power in the matter.

A lot of things have changed since 1972, not least the fact that the Supreme Court lost its power of mandatory appellate jurisdiction in the mid '80s. It is also not at all clear whether the jurisdiction in the Baker case ever extended to all same-sex marriage cases, or whether it applied only to Minnesota and the particular circumstances considered at the time.

No matter. Baker v. Nelson is now being cited as a reason why the district court in San Francisco should dismiss the Boies-Olson suit -- and any other similar federal suit -- out of hand. What makes it dangerous is that a federal judge nervous about jumping into the same-sex marriage controversy might just reach out for it gratefully as an excuse not to commit one way or the other.

That, in turn, means the Boies-Olson team might not win the lower court victory they want to maximize their chances of being heard, and then winning, in the U.S. Supreme Court.

    Erik, Have you even been paying attention to what has happened the last six months? If you had,you wouldn't write such drivel. Not only has Obama not done anything to overturn DADT or DOMA, but has written a defense of DOMA that is so offensive it compares same sex marriage to incest and argues LGBT-rights are not civil-rights. His words AGAINST gay marriage have been used by every anti-LGBT group to support their view point and he has said NOTHING about it. Maybe you don't understand what is really happening since you are in Sweden, and only get the rosy picture our press likes to paint of Obama. He will NOT move on LGBT issues, because he does not want to upset the fundamentalist chirstians who voted for him, especially conservative blacks. We were under the bus in 2007 only most LGBT didn't see it then. Most were like you probably, only listening to what Obama says and not what he does.

    It may seem unlikely, but I can't drop the thought that the 44th president will deliver...something. This is what the Obama HQ wrote me in May last year: "Re: About a gay marriage act Hi Erik.     So its either beg the electorate to vote to grant equal rights to the LGBT community or cower at the feet of the court for fear some judge is going to be a coward and opt for the easy way out. If the court is going to deny us rights, let them go on record as doing so and take their rightful place in the history of shameful acts. Our community must not compromise on demanding our full and equal rights. We will ultimately win, and when we do, those who fought to hold us back will secure their place as ignorant and bigoted.

    But normal people recover pretty much within an hour or two or a day or two, and, with normal people, your expressions of love and concern for their welfare will be taken to heart. They will be stabilized by your emotional and moral support. Not so with narcissists -- the surest way I know of to get a crushing blow to your heart is to tell a narcissist you love her or him. They will respond with a nasty power move, such as telling you to do things entirely their way or else be banished from them for ever. ^

    At this point, if you're like me, you sort of panic and want to talk to anyone who will listen about what is going on: this is a healthy reaction; it's a reality check ("who's the crazy one here?"); that you're confused by the narcissist's contrariness, that you turn to another person to help you keep your bearings, that you know something is seriously wrong and worry that it might be you are all signs that you are not a narcissist]. NOTE: Normal people can behave irrationally under emotional stress -- be confused, deny things they know, get sort of paranoid, want to be babied when they're in pain.

    Let's see if I have this right: This potentially harmful legal precedent wasn't cited by the anti-gay forces supporting Proposition 8, but was instead put forward by the Obama administration. "Fierce advocate"? I think not.
