Radio Personality Harrison Takes on Kern County

While cities throughout California commemorate June 17th’s greenlighting of same-sex marriage, the 8,000 square mile backwoods county of Kern—home to Edwards Air Force Base and the China Lake Naval Air Weapons Station—remains a virtual stand-alone in glad defiance of the California supreme court’s recent celebrated ruling.

Kern County, recently ranked by The American Lung Association as the most ozone-polluted county in the nation, is also heralded as the “Country Music Capitol of the West” and home of Cousin' Ebb Pilling of the Pumpkin Center Barn Dance.

Kern County is larger than the entire state of Connecticut, gushing 35,000 active oil wells amidst a dusty landmass of dereks, trailer parks, and 7-11s. The county seat is plopped in sun-blistered Bakersfield, made famous as the residence of “Hee-Haw” star Buck Owens. It is here that Ann Barnett, Kern County Auditor-Controller and County Clerk, decided to flash her Crucifix against the state supreme court’s equality ruling to openly administer marriage licenses to same-sex couples. Ms. Barnett even pushed County Counsel Bernard Barmann to file a legal brief with the State of California to block all same-sex marriages, statewide. But a subsequent ruling now forces her, with gritted teeth, to perform her elected duties.

Yet, Ms. Barnett continues to demonstrate little gusto to comply with the spirit of the law. An official press release issued by her office on June 4th states she’s decided to ban all marriage pronouncements—both straight and gay—thereby not signaling evidence of hand-picked discrimination. She cites: ”The County Clerk’s office will not solemnize weddings after June 13, 2008. We will not have the staff or space to deal with an increase in both licenses and ceremonies.” Wholly untrue, I later learned, after making a day trip from Los Angeles to Bakersfield, to attempt to exhume the body politic.

As I entered the County Administrative Building, five sheriff’s deputies squintily eyeballed me as I stepped into the elevator. The second-floor county clerk’s office, encased behind glass, revealed a timid receptionist who quietly signaled the office staff that an outsider was present. Perhaps wearing a sport coat hinted to my interloper status. In a friendly tone, I requested a brief audience with Ms. Barnett and was, without a second’s hesitation, denied. Immediately, a surly bureaucrat, reminiscient of a fist-pounding school principle, appeared, handing me a band-aid sized slip of paper with a name and telephone number on it. “Alliance Defense Fund. Greg Scott. 480-388-8111."

Das Bureaucrat said he would say no more and that phoning the mysterious paper strip would reveal the official position of the “unavailable” Barnett. Who or what is the Alliance Defense Fund? I asked. “Just call the number!” he said, stabbing a finger through the air. “I’m not gonna tell you again!” For a second time, I requested clarification of the paper scrap’s unsolved connection to county government, asking him if this Alliance Defense Fund was, in fact, a special governmental body granted sole voice for a taxpayer-fueled government official. “I don’t have to answer your questions,” he air-stabbed.

You’d have thought I’d been waving the commie flag or had just goosed his grandmother. No sooner had his sweaty lip begun to horripilate in a gnarled rictus, than he threatened to summon security. We clearly were getting close to something rather prickly, like who/what’s backing this elusive Ann Barnett, whose recalcitrant homophobic behavior wouldn’t be tolerated unless she were backed by some very powerful forces.

Watergate lesson #1: Follow the money.

First, I researched this “Alliance” to ascertain its role as the county propagandist. In this era of Bush-Cheney-Hooterville politics, it was hardly an eye-bugging shock to uncover that the Alliance Defense Fund (ADF) was spawned by Bill Bright (founder, Campus Crusade for Christ), James Dobson (founder, Focus on the Family), Donald Wildmon (founder, American Family Association), along with more than 30 other Christian activist organizations.

A lot of horsepower, indeed. So, I Ma Belled the Alliance Defense Fund, which found me in Scottsdale, Ariz., in an endless voicemail loop or long passages of on-hold music. When I finally found a way to circumnavigate to a live human, named Burke, he gave me a nutrition-free meal of BS-dressed word salad. Click here to listen to our conversation.

If this were some third-rate democracy, it’d be no surprise that religious forces controlled the people’s government. But this is, after all, the home turf of California's largest open pit borax mine.

To fully appreciate Bakersfield’s citizenry, one has only to wander Merle Haggard Street or visit the parking lot of the local Jack in the Box. It was there that I found Mr. Paul Barkerfelt, who thoughtfully offered: “I agree with the lady in the courthouse. If gays wanna get married, that’s fine if God wants to make another law. But when he puts lightning in [their] ass, they’ll know the difference.”

Kyle Williams, a young Bakersfielder, put it this way: “It’s an abomination of God. I’m a Christian and I go strictly by the Bible.”

Kern High School District Trustee, Mr. Chad Vegas, scrawled his outrage in a lofty letter to the Kern County Supervisor: “I am writing to make you aware of my ardent support for Ann Barnett. Please support her. Further, please know that I will work vigorously to remove from office any supervisor that does not support her in this difficult time. There is no more important political issue to the evangelical church. I want to make it clear that nothing short of complete opposition to homosexual marriage will be tolerated! As you consider your options, I remind you of the Apostle Peter in Acts 4 who asked, "should we obey man or God?" The choice is clear!”

If we are to look for guidance from the scholarly spiritualism of Kern County’s high school trustee, man-made laws such as the constitutional ban of gay marriage should not be obeyed.

In a similar convolution, the county clerk’s office published the reason for canceling all weddings by saying that they would "not have the staff or space to deal with an increase in both licenses and ceremonies. Because of long-term administrative plans, budgetary reasons…”. Yet, thanks to the diligence of the local paper, it appears that Ann Barnett’s office maintains not one, but two wedding rooms. Further, she charges $30 per ceremony and pours into the county coffers an average $50,000 a year from civil ceremonies. And those staff-depleting ceremonies take, on average, seven minutes to perform.

So, we’re left with a Constitutional conundrum as Kern County secretly blurs the line between religious zealots and the Peoples’ official business. Nevermind the separation of church and state. Of course, the Alliance Defense Fund—a non-profit organization—manages to make naughty by engaging in witch-hunting whack-a-mole under the guise of its non-profit charter. But since county officials "don’t have to answer your questions!” when confronted by the knuckle-walking, nose-picking local taxpayer, we may have to exonerate French political philosopher Alexis de Tocqueville, who said: “The people gets what government it deserves.”

    As a retired county and state official from California and a former Bakersfield resident I am very disturbed by Ms. Barnett's actions. She not only is denying civil marriages to all the people of Kern County but she is also lying about her reasons. Worst of all as Auditor she has now "cooked the books" by showing an $18,000 loss performing marriages last year. It is outrageous that the county auditor would release false figures regarding county finances to supprt her bigoted actions. That in itself is grounds for recall. It is time for the Kern County Board of Supervisors to hire an outside auditor to audit the elected auditor.

    Bakersfield is not a town of raging conservatives and hicks. It's just those are the ones who shoot off their bigoted bs and the media eats it up. IMO, Bakersfield is home to more moderates than it is given credit for. Ann Barnett has received a lot of criticism from people here, and as others have said, only 1 protestor showed up on Tuesday. Vegas is also receiving a lot of criticism for his actions, and it's not just outsiders suggesting he be recalled. What you will find is there are alot of people who are opposed to gay marriage...no doubt about that, but many are starting to say they won't actively oppose in November. As someone who lives in Bakersfield, I'm hearing more and more people who don't agree with gay marriage say they don't have the right to stop it.

    The fact is that two different freedoms are in conflict with each other. GLBT civil rites and the freedom to religious beliefs. The difference however is that GLBT are not attempting to use their power or votes to prevent anyone from pursuing their religious beliefs for themselves. Religious people ARE attempting to use tehir power and votes to prevent GLBT from leading their lives to their full potential. People can believe whatever mythologies tehy've been brainwashed into, it doesn't give them the rite to dictate to other people who they can love nor limit their potential as a human being. YOur freedom of religion does not superceded my rite as a seperate individual to pursue my life as I see fit.

    Mark from Middleboro - There were several ceremonies held in front of the county clerk's office, and one whole protester showed up. Laurie, you are correct the exact phrase separation of church and state does not appear in the consitution, but the phrase you quoted "Congress shall make no law respecting an establishment of religion..." means just that, congress shall not make laws based on religion. Therefore, this phrase that you quoted, would mean a separation of church and state.

    Since when do individual County Clerks make policy? Their sole job is to process documents for the public. As such, they are Public Servants, and in fact, take an Oath of Office to uphold the Constitution of California. If they disagree with the Supreme Court's ruling, then their choice is very simple and clear. Find another job. The Secretary of State needs to do his job and ensure that ALL county offices in California are abiding by the law - not their own beliefs or predjudices - the law. It's that simple.

    Oh, and "Chris" - there are people who could not be "won over" in a million-years. The key is to know when to spot the those that have rational and intelligent minds and those that don't. The only reason the Republican Party won the last few elections is because the GOP is masterful at exploiting people's fears and prejudices *(terrorists, gays etc.) and look at the absolutely shit*y job they've done - in almost every category that can be evaluated, they have been abyssmal failures. Hopefully, November will see a return to common sense in this country. If not, we essentially deserve whatever we get.

The laws regarding same-sex marriage, if you actually bothered to read or inform yourself about the law, DO NOT allow for polygamy or incest. Be careful of the unintended consequences of asking for equal rights for all orientations (sexual or otherwise) beliefs or actions.     New thought, I wish I still lived there. I would organize a group of couples to go to the Bakersfield office, apply for the liscense which they have to issue. But I would bring my own JP and have the ceremony outside the building. J of P's are by law a employee of the State which can use the government property. Peaceful protest that Barnett could do nothing about. I'm there is at least one person in that office that disagree's with her bigotry. Mark

    Laurie, Never in the history of the United States have the people been allowed to vote on people's equal rights. How would you feel if we voted to restrict all religious services except for Sunday. This is not a one solution fits all America. People deserve to be able to create bonds of love through marriage, not matter what sex the 2 are. Why should you be allowed to say or determine what is right or what is wrong for me. The bible is the oldest piece of fiction literature ever written. The is no proof that any of what is written ever happened.     I don't believe in casting a whole town under one light either. Though, I have to say that people who are so fanatical about their religious beliefs frequently do act very unstable - as if they've lost the ability to think or act in an intelligent or rational manner. I'm sure there are some really wonderful people in Bakerfield and I hope that good common sense can prevail in their leadership. As for the woman who attempted to justify her ignorance by stating that the will of Californians was overturned by the courts. You need a serious education in what the judiciary's function is. It's purpose is NOT to reflect the will of the majority but rather to interpret the law, popular or not. Massachsettes has had gay marriage for years and other countries like Canada, Spain etc. have had it for some time and low and behold - the world did not fall apart because same sex couples could lead happier lives.

Godfrey, an even better question to ask yourself is why would a (presumably) straight person spend so much time wondering what gay/lesbian people are attracted to? Is there some sort of confusion you're trying to sort out for yourself? The problem with so many Bakersfield residents is that they are so concerned with what other people do/don't do that they must not have time to better themselves in anyway, including learning how to frame an argument that doesn't include personal attacks and does include any points relevant to the discussion at hand. When it comes to gay marriage, their argument pretty much extends to "the bible says it's wrong, and F you if you disagree." So very Christian of you. I wonder if Jesus would stand by and watch two people who genuinely love getting married, and scream hate at them.

    Maybe we can get a ballot measure passed for November that doesn't allow hetrosexuals to get married if 1) they are no longer virgins 2) have already been married and divorced 3) lived with someone they were not married to 4) are infertile 5) they have kids out of wedlock 6) they want to marry someone other than their illegitimate childrens biological parent 7) can't marry someone doing time in prison 8) are aetheists 90 are on welfare, or ever have been on welfare 9) don't make their child support payments 10) have no health insurance 11) are not financially stable, etc.....

    Sorry J....the Constitution says nothing about separation of church and state. I will quote a portion of the First Amendment for you, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech...". I am very familiar with the Constitution. I think some people are reading into my statements what they want to and not what I actually wrote. I have no hate or animosity towards anyone, as some have inferred in later posts. I simply want the Constitution of the United States of America upheld, not some modern day interpretation based on what other countries or a minority of people believe. We are a country to be governed by the people and for the people. If the majority of people vote for a certain right, I can respect that. I respect your right to free speech and hope you will respect mine without hate.

    Sorry for the double posts, this page keeps freezing on me. Anyways, I had to do a second post to fit everything I wanted to type, I couldn't shorten it anymore than I already had. As for someone else from Bakersfield commenting on the constitution, perhaps you should learn more about the constitution. This country was founded on the freedom of religion, the constitution says there should be a separation of church and state, denying gay rights because it is a "sin" is in direct defiance of the constitution.

Life is a little slower here than, say, Los Angeles, but is that really bad? Bakersfield does have strong country roots; that doesn't mean we are all hicks. It is a slower paced city that is close to everything, a little over an hour to LA, to the beach, and 4 hours to Vegas. Please don't assume that we all have the same beliefs as Ann Barnett. Why didn't you write about how someone picked up the paperwork to start a recall on her because of this? If the paper is pointing out that the county makes money from the marriages and that the county has 2 rooms to perform the marriages, shouldn't that signify that there must be a good amount of people here who do not share her viewpoint? Newspapers print stories to make money, why would they print that story if everyone here supported her decision?

    As a transplant to Bakersfield from L.A., I can tell you it is the most backwards, ignorant set of people I've ever come across. They are downright proud of their stupidity and lack of education. They think anyone who didn't grow up in Kern County is suspect, and think you're "some kind of snob" if you have a college education. Their rampant homophobia is just another symptom of a much, much larger problem. These are people who think a trip an hour south to Los Angeles is an exotic journey to the unknown (I've met a handful of people here who have never made the trip at all), so the idea that a gay couple is "allowed" to marry is extremely threatening to their trailer-park values.

    So, if you go by Lori's comments, Blacks would not have rights because the majority of Americans didn't think that it was wrong to have segregation, etc.? No. It was wrong then, and it's wrong now. This is about human rights and equality; not something which happens in Bakersfield very often.

    Keep in mind that the "people" of the United State of America should be the voice of the government, not the courts, supreme or otherwise. I am appalled by the audacity of our courts to simply cite decisions made in other countries to back up their rulings versus the content of our own Constitution. If the majority of people are Christian conservative than that is the voice of the people speaking. Unfortunately in today's climate one is forced to tolerate the views of the minority in the name of political correctness. This is a call to action for the "people" of this great nation to stand up and make their voices heard by those in the minority, whether those in the minority like it or not.     The wedding ceremonies,around 3,took place outside today~ surrounded by media,and well wishers. It is true "Bakwardsfield" or more correctly Bakersfield ,is full of staunch conservatives it is slowly changing~ I know because it is my hometown. Thanks for the humorous take on a serious issue.

    WOW what an impressive story.,.. sounds like you visited NAZI germany Now whe my daughter sees pictures of two men getting married inn the paper I can explain to her some men like to stick things where food comes out I would wager half of these marraiages will be over in less than a year

    Great article Harrison and some impressive research! It's probably clear to most people who follow GLBT politics what was really going on here - but to have it laid out so clearly is very much appreciated.
