More than a dozen Arkansas families filed suit Tuesday challenging the state's adoption ban.
"This law stands in the way of our child getting the medical care she will desperately need," says Amanda Dennis, mother of a trans daughter.
The law, banning hormone treatment and puberty blockers as well as gender-affirming surgeries, was set to go into effect July 28.
Transgender, nonbinary, and intersex residents are suing over a new policy that makes it nearly impossible to change their gender marker and bans the use of a gender-neutral one.
It was the first such ban enacted and now is the first one ruled unconstitutional.
Legislators Tuesday overrode Gov. Asa Hutchinson's veto, making Arkansas the first state with such a law.
The Sixth Circuit had ruled similarly in a case out of Tennessee.
Trans, nonbinary, and intersexed residents are no longer able to accurately represent their gender identity.
The Arkansas supreme court on Thursday upheld a lower court ruling that said gays and lesbians cannot be barred from the foster care system.
The state's Senate approved a bill Monday and the House had passed it earlier this month, so it now goes to Gov. Asa Hutchinson.
Idaho's law making it a felony to provide such care to minors is unconstitutional, according to the suit.
